Understanding Property Division During Divorce In California

California is a community property state. Property acquired during a marriage or a domestic partnership is typically classified as community property, with limited exceptions. Separate property includes property acquired by a spouse prior to a marriage and certain property acquired during a marriage, such as property acquired by gift or inheritance.

When spouses are unable to reach an agreement about how their property should be divided, a court will generally divide their property in an equitable fashion. While a court generally divides community property on an equal 50-50 basis, disputes often arise and an equitable division may not require an equal 50-50 split.

Taking Your Needs And Wants Into Account

It is critically important for divorce attorneys to listen to their clients and identify their needs and objectives. What works for one client may not work for another. At the start of your case, we will take the time necessary to determine the issues that you consider to be most important. For some clients, receiving an award of the marital home is critical. For others, having full control of a business or equal ownership of business income, access to liquid assets, such as investment or savings accounts, is more important.

When analyzing property division issues, especially those involving businesses or real property, we take into account all financial matters that may impact your financial security, including how a spouse can maintain real property and business interests, child support and spousal support. Using this broad-based perspective, we will help you get a better picture of how you will be situated after your divorce. We will also give you candid advice, so you will understand how a judge may view your case should you determine to take your case to court.

Many disputes in divorce cases are the result of clients not fully understanding how issues are typically resolved by courts. By providing our clients with a clear understanding of how such issues are generally resolved, we empower them to make informed decisions that will positively impact the outcome of their cases.
